ReactionSports, LLC respects your privacy and understands the importance of protecting the personal information you provide to us when you use the SwingReaction™ Application (the “SwingReaction Application” or the “Application”). 

When you use the SwingReaction Application, we collect certain information that, alone or in combination with other information, could be used to directly or indirectly identify you or your household (collectively, "Personal Information"). This Privacy Policy explains how we use your Personal Information, or, if you are the parent or legal guardian of a child under the age of 18, the Personal Information about that child, in which case the use of “you/your/yours” refers to that child.  

We may update this Privacy Policy from time to time so be sure to check back from time to time to see if the “last revised” date has changed. 

Our Collection and Use of your Personal Information

What we collect. 

ReactionSports may collect and retain the following categories of Personal Information:

A. Identifiers: Name, mailing address, email address, date of birth, gender, Internet Protocol address, phone number.

B. Customer information categories listed in the California Customer Records statute: Name, mailing address, email address, date of birth, gender, Internet Protocol address, phone number.

C. Characteristics of protected classifications under California or federal law: Gender, gender expression, race, color, disability.

D. Commercial information: Credit or debit card numbers, expiration dates, and security codes provided when you purchase or renew your Subscription; records of products or services purchased, obtained, or considered; content of texts or emails sent to ReactionSports.

F. Electronic network activity information: Information about interaction with the SwingReaction Application.

H. Audio, video, and similar information: Video recordings, audio recordings, photographs, voice recordings uploaded, captured, or stored through the account.

K. Inferences drawn from other personal information: Inferences drawn from the Personal Information collected may be used to create a profile about physical characteristics, abilities, and aptitudes.

How we obtain your Personal Information.

We obtain your Personal Information in the following ways:

• Directly from you when you provide it to us via the Application and use the Application; for example, when you subscribe to the Application and when you take or upload videos.

• Indirectly from you when you access and use the Application, such as information about your interaction with the Application.

• Directly and indirectly through third-parties service providers (“Service Providers”), such as our payment processing services.

How we use and share your Personal Information and for what purposes.

We do not sell any of your Personal Information.

We may use your Personal Information and/or share your Personal Information with Service Providers for the following purposes (the “Purposes”):

• To provide, maintain, and improve the functionality of the Application.

• To maintain your account and your subscription to the Application.

• To contact you regarding updates, news, and other information about the Application.

• To fulfill our obligations under, or to enforce our rights under, any contracts between you and us, including this Privacy Policy and our Terms of Service. 

• To help us understand the Application'ts demographics and user preferences, and to evaluate the Application’s operations.

• To evaluate the possibility of, or to engage in, a merger, divestiture, restructuring, reorganization, dissolution, or other transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which your Personal Information is among the assets being transferred.

• To protect against fraud and other security risks.

Note that our use of your Personal Information for some of the Purposes may include sharing your Personal Information with carefully selected artificial intelligence tools, which we use to maintain and improve the Application.

We will also disclose Personal Information in the following circumstances: 

• Disclosure is required by law enforcement or judicial authorities, or otherwise to cooperate with a law enforcement investigation. 

• Disclosure is required by mandatory professional standards.

• We have a good faith belief that we are required or permitted to do so by law or legal process.

• To protect our rights, reputation, property or the safety of us or others.

• To defend or enforce our rights or your obligations.

How long we retain your Personal Information. 

Unless you have requested that we delete your Personal Information (see Your Rights and Options below) and we have done so, we may retain your Personal Information for as long as we deem reasonably necessary to fulfill the Purposes or meet our legal obligations. 

Tracking Technologies. 

When you use the Application, we may automatically collect your Personal Information by using cookies, web beacons, pixel tags and other tracking technologies (collectively, "Tracking Technologies"). We use Tracking Technologies in various ways to enable and enhance your use of the Application.

Your Rights and Options

For any Personal Information regarding a person under the age of 18 (“Minor”), the following rights and options belong to the parents and legal guardians of the Minor.

Right to Opt Out.

You have the right to opt out of ReactionSports’s sharing of your Personal Information. Note that doing so may affect your ability to use the Application.

A parent or legal guardian of Minor also has the right to opt out of our collection, sharing, and use of Personal Information about the Minor. Note that doing so may affect your or your Minor’s ability to use the Application.

Right to Disclosure.

You have the right to request that we disclose to you the following information about our collection and use of your Personal Information over the previous 12 months:

• The categories of Personal Information we collected about you.

• The specific pieces of Personal Information we collected about you.

• The categories of sources from which the Personal Information was collected.

• The categories of your Personal Information that we shared with third parties.

• The specific pieces of your Personal Information that we shared with third parties.

• The categories of third parties with whom we share your Personal Information.

• Our business or commercial purpose for collecting or sharing the Personal Information.

• The categories of Personal Information disclosed for a business purpose and the categories of persons to whom it was disclosed.

Right to Deletion of Personal Information.

You have the right to request that we delete your Personal Information. We will comply with such request, subject to certain exceptions permitted by applicable law. Note that doing so may affect your ability to use the Application.

Right to Correct Personal Information.

You have a right to request that we correct any inaccurate Personal Information about you. We may ask that you provide documentation showing that the information is inaccurate.

Exercising Your Rights.

For your protection, we may require that you provide information verifying your identity and may refuse to honor your request until we have been able to verify your identity. If you are a parent or legal guardian requesting to exercise any of the above rights regarding Personal Information about your child under the age of 18, we may require that you provide additional appropriate verification.

Non-Discrimination.

We will not discriminate against you for exercising any of the rights described above.
